ORDER OF PUBLICATION
The object of this suit is to: ENFORCE THE LIEN OF THE COMPLAINANT, COUNTY OF BOTETOURT, Virginia, for delinquent real estate taxes against certain real property located in the County of Botetourt, Virginia, described as follows:
Tax Map No. 61-73A Account No. 21409
All that certain tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, lying and being in the Fincastle Magisterial District, Botetourt County, Virginia, and further described as follows, to-wit:
Beginning at an iron pin adjacent to Virginia State Route No. 630; thence S 18°42’ 22” E 191.24 feet to a point; thence N 69° 19’ 52” W 347.79 feet to a point; thence N 20° 40’ 08” E 153.53 feet to a point; thence S 69° 19’ 52” E 132.77 feet to a point; thence with a curve to the right with an arc of 93.94 feet and a chord bearing S 65° 51’12” E a chord distance of 93.88 to the place of beginning, containing 1 acre, more or less, as shown on plat survey by Charles R. McMurry, CLS, dated May 25, 1983, and of record o\in the Clerk’s Office of the Circuit Court of Botetourt County, Virginia in Deed Book 284, at Page 590.
And being the same property conveyed to Charles Edward Kyle and Robyn Dillon Kyle, husband and wife, as tenants by the entirety with the right of survivorship, from Earl G. Cahoon and Annabelle Tucker Cahoon, husband and wife, by Deed dated May 30, 1983, and recorded June 7, 1983, in the Clerk’s Office of the Circuit Court of Botetourt County, Virginia, in Deed Book 284, at Page 588.
This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described including but not limited to those recorded in Deed Book 170, at Page 196.
IT APPEARING that an Affidavit has been made and filed stating that due diligence has been used, without effect, to ascertain the identity and location of certain parties to be served, that the last known addresses for the Respondenets herein are as follows: Charles Edward Kyle, who is believed to be deceased and whose last known address is P.O. Box 201, Fincastle, Virginia 24090; Robyn Dillon Kyle, and whose last known address is P.O. Box 201, Fincastle, Virginia 24090;and that any officers, heirs, devisees, and successors in title of the Respondent named herein are made parties Respondent to this action individually and/or by the general description of Parties Unknown, it is hereby
ORDERED that the parties herein and all Parties unknown and/or whose location cannot be ascertained appear o n or before March 3, 2025 in the Clerk’s Office of the Circuit Court of The County of Botetourt, Virginia, and do what maybe necessary to protect their interests in this cause.
