Virginia Burning Law now in effect

Virginia’s 4 PM Burning Law is in effect from February 15 to April 30 each year. The law prohibits open-air burning before 4 PM if the fire is within 300 feet of dry grass or woods.

What does the law prohibit?

  • Open-air burning before 4 PM within 300 feet of dry grass or woods
  • Burning in barrels
  • Throwing cigarettes or cigars on the ground or from a vehicle

What is allowed?

  • Open-air burning between 4 PM and midnight if proper precautions are taken
  • Using charcoal or gas-fired barbecue grills if proper precautions are taken

Why is the law in place? 

  • To reduce the number of wildfires that occur in the spring
  • To control invasive and exotic plant species
  • To maintain and establish wildlife habitats
  • To manage natural heritage resources

What are the consequences of violating the law? A Class 3 misdemeanor and a fine of up to $500.
