In execution of a Deed of Trust dated July 19, 2013, recorded in the Clerk’s Office of the Circuit Court for Botetourt County, Virginia, as Instrument No. 130003388, the Substitute Trustee will offer the above-described property for sale to the highest bidder at public auction on the date and time referenced below.
Beginning at an iron pin found at the northeast corner of the James W. Zell, III, 1.719 acre tract; thence N. 89-50-51 E. 119.80 feet to an iron pin; thence S. 0-25-02 W. 529.29 feet to an iron pin; thence N. 77-51-01 W. 122.35 feet to an iron pin, corner to the aforementioned James W. Zell, III, tract; thence N. 0-25-02 E. 503.22 feet to the place of beginning, containing 1.42 acres, more or less, as shown on plat of survey by Lewis A. Hickman, Jr. C.L.S., dated November 7, 1978, a copy which is recorded in the Clerk’s Office of the Circuit Court of Botetourt County, Virginia, in Deed Book 324, Page 356, the said property being a part of the property conveyed to Frances Elizabeth Zell by S. San Juan, et al, by deed dated October 2, 1946, and recorded in the Clerk’s Office of the Circuit Court of Botetourt County, in Deed Book 97, at Page 170.
TOGETHER WITH a perpetual right of way and easement, 15 feet in width, over the existing road, for the purposes of ingress and egress, between the property herein conveyed, the remaining property of the party of the first part, and U. S. Route 220, said right of way and easement to be non-exclusive and located generally along the southern edge of the 8.40 acre tract conveyed by Deed dated July 24, 1975, and recorded in the aforesaid Clerk’s Office in Deed Book 222, at Page 291.
Date of Sale: May 1, 2025 at 9:30 a.m. at Botetourt County Circuit Court, 1 West Main Street #120, Fincastle, VA 24090.
Terms: CASH: a deposit in the form of certified funds in the amount of $10,000 or 10% of the sale price, whichever is lower. Settlement within thirty (30) days of date of sale. Time is of the essence.
OPTIONS:
- All costs of conveyance, examination of title, recording charges, etc. will be at cost of purchaser with the exception of the grantor’s tax. Neither the Substitute Trustee nor any other party guarantees or covenants to deliver or in any way to obtain possession of the premises for any third party purchaser.
- The Substitute Trustee reserves the right to reject all bids, extend the time to receive bids or withdraw the property from sale at any time. In addition, should the Substitute Trustee be unable, for any reason, in its sole discretion, to convey title, the successful bidder’s sole remedy in law or equity shall be the return of his deposit. Upon refund of the deposit, the sale shall be void and of no effect.
Additional terms may be announced at the time of the sale. The Substitute Trustee will convey the above-described property to the purchaser(s) by Special Warranty deed at settlement and makes no additional representations or warranties of any kind regarding the title to said property.
