In execution of a Deed of Trust dated May 11, 2012, recorded in the Clerk’s Office of the Circuit Court for Botetourt County, Virginia, as Instrument No. 120002089, the Substitute Trustee will offer the above-described property for sale to the highest bidder at public auction on the date and time referenced below.
All those certain lots or parcels of land, with buildings thereon and appurtenances thereunto appertaining, lying and being in the Town of Buchanan, Buchanan Magisterial District, Botetourt County, Virginia, and more particularly described as follows, to-wit:
Beginning in the center of an alley on the south side of Boyd Street 255.1 ft. east of Bedford Street, thence with the south line of Boyd St., N. 42 E. 150 ft.; thence S. 48 E. 167.77 ft. to a 15 foot alley; thence with the north line of said alley S. 42 W. 150 ft. to the center of the alley first above named; thence N. 48 W. 167.77 ft. to the place of Beginning.
SUBJECT to the agreement that the alley first above mentioned and named on the west side of the property hereby conveyed shall be kept open for the convenience of the owners of the lots of land adjoining the same, as more particularly set forth in that certain deed dated May 30, 1989, of record in the Clerk’s Office of the Circuit Court for the County of Botetourt, Virginia, in Deed Book 362, page 511.
Date of Sale: November 20, 2024 at 9:30 a.m. at Botetourt County Circuit Court, 1West Main Street, Suite 120, Fincastle, VA 24090.
Terms: CASH: a deposit in the form of certified funds in the amount of $10,000 or 10% of the sale price, whichever is lower. Settlement within thirty (30) days of date of sale. Time is of the essence.
OPTIONS:
- All costs of conveyance, examination of title, recording charges, etc. will be at cost of purchaser with the exception of the grantor’s tax. Neither the Substitute Trustee nor any other party guarantees or covenants to deliver or in any way to obtain possession of the premises for any third party purchaser.
- The Substitute Trustee reserves the right to reject all bids, extend the time to receive bids or withdraw the property from sale at any time. In addition, should the Substitute Trustee be unable, for any reason, in its sole discretion, to convey title, the successful bidder’s sole remedy in law or equity shall be the return of his deposit. Upon refund of the deposit, the sale shall be void and of no effect.
Additional terms may be announced at the time of the sale. The Substitute Trustee will convey the above-described property to the purchaser(s) by Special Warranty deed at settlement and makes no additional representations or warranties of any kind regarding the title to said property.
