Botetourt County announces settlement for the Fincastle courthouse project

The Botetourt County Board of Supervisors approved a settlement regarding specific legal matters the board reviewed and considered about the ongoing courthouse project in Fincastle at a special meeting held last week in Daleville.

In a press release Friday, it explained that there was a recommended resolution from the county attorney and county staff for the board to approve a settlement agreement with the construction company (KNA) and Surety (bonding company) regarding the Fincastle Courthouse Project.

The resolution explains that the project’s contractor, KNA Construstion, LLC, entered into a construction contract with Botetourt County on October 26, 2022. The bonding company, Surety, issued a performance bond weeks prior to the county’s agreement with KNA.

The total construction project for package A was bid for $5,208,657. Package A consisted of site preparation and demolition of the current courthouse. On July 28, 2023, the county issued to KNA a “Notice of Default and Right to Cure.”

After negotiations, Botetourt County will receive compensation totaling $850,000. Botetourt County Capital Projects Manager Rich Evans will be working with pre-qualified contractors to appropriately solicit bids to complete the courthouse construction project as soon as it can be accomplished.

“This has been an extremely complicated situation to work through,” the release went on to say. “Botetourt County has lost construction time, however fortunately, due to the work of the Botetourt County team, including our legal counsel, financial losses have been substantially mitigated. The timeframe for the completion of the project is still to be determined, pending final design and bidding for construction.”
