In execution of a certain deed of trust dated September 25, 2009 and recorded on September 30, 2009, in the Clerk’s Office of the Circuit Court of Botetourt County, Virginia, as Instrument #090005254, Justin C. Smart, Substitute Trustee, will offer for sale at public auction to the highest bidder at the front entrance of the Botetourt County Circuit Courthouse, 1 Main Street, Fincastle, Virginia, on the 3rd day of December, 2020 at 10:00 a.m., the following described real estate located at 3178 Roanoke Road, Daleville, Virginia 24083 ( Botetourt County, Virginia), and more particularly described as follows:
All that certain tract or parcel of land with improvements hereon lying and being situate in the Amsterdam Magisterial District of the County of Botetourt, Virginia, containing 1.5168 acres new, by survey, with metes and bounds as shown on plat of survey made by Christopher N. McMurry, L.S., dated May 31, 2002, a copy of which plat is recorded in the Office of the Clerk of the Circuit Court of Botetourt, County, Virginia in Plat Book 26, page 85; less and except that portion of the subject property conveyed to the Commonwealth of Virginia by deed dated February 24, 2000, recorded in Deed Book 587, page 1114.
This conveyance is subject to all easements, restrictions, conditions, and reservations of record affecting the title to this property hereinabove described.
The beneficiary reserves the right to bid at said sale.
TERMS OF SALE: Certified funds or cashier’s checks. A bidder’s deposit of Ten Percent (10%) must be present at the time of the Trustee’s Sale with settlement in full to be made within 15 days from the date of said Sale.
