Default having been made in the terms of a certain Deed of Trust dated June 28, 2017, in the original principal amount of $123,717.00 and recorded in the Clerk’s Office of the Circuit Court of the County of Botetourt, Virginia on June 29, 2017, as Instrument Number 170002499, the undersigned Substitute Trustees will sell at public auction on July 6, 2022 at 2:00 PM, in front of the building housing the County of Botetourt Circuit Court,
1 W. Main Street, Fincastle, VA 24090. The property designated as BEGINNING at a point in the centerline of State Route 643, corner to Johnnie B. Eubank (DB 373, PG 785); thence with the said centerline of State Route 643, S. 08° 18` 06″ W. 26.22 feet to a point; thence continuing with said centerline, S. 11° 30` 53″ W. 163.15 feet to a point; thence following the curvature of said centerline an arc distance of 42.16 feet (said arc having a chord bearing of S. 05° 42″ 56″ W. and a chord distance of 42.09 feet) to a point; thence leaving said centerline and with the line of Parcel 2 on the below referenced plat, S. 83° 12` 30″ W. 389.48 feet to an iron pin set, corner to E.C. and Rebecca Montgomery property; thence N. 87° 54` 35″ W. 129.75 feet to an iron pin found; thence N. 01° 50` 24″ W. 337.19 feet to an iron pin set; thence S. 83° 10` 18″ E. 571.84 feet to the point of BEGINNING, containing 3.60 acres, more or less, and designated as Parcel 1 on plat of survey for Pat H. Eubank, dated June 14, 1990, prepared by Charles R. McMurry, C.L.S., and recorded in the aforesaid Clerk`s Office in Deed Book 35, page 266. Sale is subject to all prior liens, easements, restrictions, covenants, and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises.
TERMS: CASH. A deposit of $12,000.00 or 10% of the sale price, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $9,900.00 of cash will be accepted. The successful bidder’s deposit will be retained at the sale and applied to the sale price. If held by the trustee, all other bid deposits will be returned to the unsuccessful bidders. Settlement is to be made within 15 days. The successful bidder will be responsible for obtaining possession of the property, and for all costs and fees related to recording the Trustee’s Deed, including the grantors tax. The successful bidder will be required to execute a Memorandum of Trustee’s Sale, available for review upon request before the sale, outlining additional terms of sale and settlement.
