
Virginia’s 4 PM Burning Law is in effect from February 15 to April 30 each year. The law prohibits open-air burning before 4 PM if the fire is within 300 feet of dry grass or woods.
What does the law prohibit?
- Open-air burning before 4 PM within 300 feet of dry grass or woods
- Burning in barrels
- Throwing cigarettes or cigars on the ground or from a vehicle
What is allowed?
- Open-air burning between 4 PM and midnight if proper precautions are taken
- Using charcoal or gas-fired barbecue grills if proper precautions are taken
Why is the law in place?
- To reduce the number of wildfires that occur in the spring
- To control invasive and exotic plant species
- To maintain and establish wildlife habitats
- To manage natural heritage resources
What are the consequences of violating the law? A Class 3 misdemeanor and a fine of up to $500.
